Terms of use for registered users of the school survey website

By using this website, you signify that you have read and accept these Terms of Use. If you do not agree to these Terms of Use, do not use the website.

The material on this Website is the copyright of the Audit Commission (“the Commission”) unless otherwise indicated.

The Commission shall use its reasonable endeavours to ensure that the information contained on the website is accurate and up to date.

The Commission may make improvements or changes in the information, services, products, and other materials on this website, or terminate this website, at any time without notice.

Please check these terms periodically for changes. Your continued use of this website following the posting of changes to these terms (including our Privacy Policy) will mean you accept those changes.

General Overview

The website provides you with access to the 2009 annual national school survey. The survey is available in an electronic format in line with the Government's e-government policy.

1. Disclosure of Information

Any personal information you supply to the Commission will be used as set out in our Privacy Policy. You shall use reasonable endeavours to ensure that all details and representations you provide to us for the purpose of registering on the website are correct.

The School Survey has been developed through a partnership between the Commission , Ofsted, the Wales Audit Office, Estyn and councils. The Commission owns the School Survey website as well as the paper-based version of the School Survey which supports the website data collection exercise. All intellectual property, including copyright, in the school survey and all information obtained through the survey will be the property of the Audit Commission.

For the 2009 survey, the Commission will simplify the amount of information released as standard and plans to provide to all councils an enhanced version of the current summary statistics which will report all participating councils’ average scores and allow selection by question and phase etc.

Public access will be provided to a version of the 2009 England summary statistics which will compare average council performance against a national average. We consider that this will meet Freedom of Information requirements and be more in line with the ways in which other related survey and CAA information is reported. We will release the names of the councils that achieve top-quartile ratings in our national comparisons (for the purpose of sharing of good practice). Public access will be given to  aggregated national and statistical neighbour data in order to benchmark the results. We expect participating councils to share their results with their schools as a matter of course; we will provide analysis reports to schools which contact the Audit Commission to request these.

Data from the survey may be used as inspection evidence by the Audit Commission in conjunction with Ofsted and other inspectorates involved in Comprehensive Area Assessments (CAA) (in England) and by the Wales Audit Office and Estyn in LEA inspection and performance work (in Wales).. To this end we may share survey data with other CAA inspectorates and the DCSF  Data from the survey may be used internally by the Audit Commission for the purpose of the exercise of any functions of the Commission or an auditor under the Audit Commission Act 1998. This may include studies, audits and public interest reports. Care will be taken not to name individual councils in external publications.

As a public authority, we are subject to the Freedom of Information Act 2000 (FOIA) and information supplied to us, including completed surveys, may be subject to disclosure under FOIA. We will make every effort to consult with the relevant participant(s) before disclosing all or part of the information which is the subject of an FOIA request. When considering whether to disclose the requested information the Commission will take into account section 49 of the Audit Commission Act 1998, which prohibits disclosure unless certain conditions are met,, the Data Protection Act 1998 and other relevant factors.

Responses from individual schools are not attributable to any person or role - the response is considered to be that of the school as a body. Qualitative feedback (comments) from schools will be provided to their council on an anonymised basis but are not edited in any way; schools are advised that their comments should not name any individuals within the council.

In maintaining the effectiveness with which the process (the School Survey) is being delivered, the process is enhanced when responses made by schools are unrestrained, frank and candid. The disclosure of school survey information other than in the ways specified above may have an inhibiting consequence on the future delivery and integrity of the survey project, in the following ways:

  • Reduced frankness and candour from schools to future surveys, leading to a less effective and independent survey.
  • A likely reduction in the number of councils which wish to participate in the project, harming the usefulness of benchmarking comparisons and the extent to which conclusions can be drawn from the results on a national basis.

2. Restrictions on use of material

This website may only be used in accordance with these Terms and Conditions and only for a lawful and proper purpose.

Material on this website is the intellectual property of the Audit Commission and is subject to copyright protection unless otherwise indicated. The Commission gives you permission, unless otherwise indicated, to copy, reproduce or republish material owned by the Commission from the website provided that:

  1. The material is not copied, reproduced or republished for commercial purposes. If you wish to use the material for commercial purposes you must first get the Commission's written consent.
  2. The material is not modified or amended in any way without the prior written consent of the Commission.
  3. All accompanying copyright, trademark and other proprietary notices are kept intact.
  4. The Commission's work is acknowledged in any reproduction of Commission material, either in whole or part.

You may download the survey but you are not permitted to amend or alter the form of survey. The survey relates to the collection of responses by the Commission, during the period from 3 June to 15 July 2009, of schools' views of their council services. You are not permitted to use this survey for any other purpose or provide this survey to any third party without the Commission's prior written consent.

You may download the survey analysis but you are not permitted to amend or alter the form of survey analysis except that, once downloaded, the data within the analysis may be saved in a different format provided that the results of the analysis are reproduced accurately and not used in a derogatory manner or misleading way. If the format of the analysis is changed or where it is issued to others with the Commission's consent, the source and copyright status must be acknowledged.

Any use or exploitation of the materials for any other purpose may be an infringement of copyright, database right or other intellectual property rights of the Commission. Modification of any of the materials, including the survey and associated analysis, or use of the materials for any other purpose will be a violation of the Commission's trademark and other intellectual property rights.

The Commission reserves the right at any time and in its absolute discretion to withdraw permission for you to copy, reproduce or republish material if it has reason to believe that material is being used inappropriately or for commercial purposes.

The Commission may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the website. Accordingly your continued access or use of this website shall be deemed your acceptance of the terms applicable from time to time.

Any information shown as belonging to or created by a third party may not be copied without the permission of the copyright owner. The Commission cannot and does not give any permission to use third party material.

You may not:

  1. use the Website to do anything which would result in the Audit Commission being brought into disrepute by association, or which  may be perceived as discrediting the Audit Commission’s independence
  2. use the Website for any advertising or promoting a particular product or in a way to suggest endorsement of any product by the Audit Commission
  3. use the Website in any way which would distort or alter the original intention and meaning
  4. make use of the Audit Commission’s name, corporate logo or corporate identity in any advertisement, logo, or similar without the Audit Commission’s express prior written consent.
  5. alter, deface or interfere with the website or post any material harmful to the Website.
  6. attempt to copy, sell, lease, rent licence or grant any rights to the website

All information, services, and materials are provided 'as is' and 'as available' without warranty of any kind. The Commission shall not be responsible for your use of any information and is not responsible for any errors, omissions or out of date information. If you are relying on any information provided on the Website you should seek independent advice.

The Commission further accepts no responsibility or liability for, and makes no warranties, that functions contained at this website will be uninterrupted or error-free or that defects will be corrected or that this website or the server that makes it available is free of any virus or other harmful elements. The Commission is not responsible for any disruption to the Website or loss or corruption of any information whilst using the Website. For your own safety you should take regular back-up copies of data and use the latest virus checking software and the Commission cannot accept any liability arising from your failure to do so. Note that some jurisdictions do not allow the exclusions of implied warranties so some or all of the above exclusions may not apply to you.

This website is controlled and operated by the Commission from its offices in London and Bristol. The Commission makes no representation that materials on the Website are appropriate or available for use in other locations. Those who choose to access this Website from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

6. Other

These terms shall be governed by and construed in accordance with the laws of England and Wales. If any provision of these terms shall be unlawful, void for any reason, unenforceable, then that provision shall be deemed severable from those terms and shall not affect the validity and enforceability of any remaining provisions.

In the course of your use of this website, you may provide to the Commission or the Commission may otherwise obtain information about you. This information may be used by the Commission to catalogue your interests or information services which you download.
